Terms and Conditions

These Terms & Conditions (“Terms”) govern the use of services provided by ES Advising (“we,” “us,” or “our”). By accessing our website, booking services, or engaging our consulting services, you (“the Client”) agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services.

1. Services Provided

ES Advising provides educational consulting and advisory services, including but not limited to:

  • University and post-secondary admissions advising

  • Application strategy, planning, and document review

  • Support for Canadian, U.S., U.K., and international applications

  • K–12 academic guidance and educational planning

Services may be offered on an hourly basis or through packaged offerings and may be delivered virtually and/or in person, depending on availability and client preference.

Our services are advisory in nature and are not a substitute for decisions made by educational institutions.

2. University Admissions Disclaimer & No Guarantee of Outcomes

ES Advising provides educational consulting services only. We are not affiliated with, endorsed by, or acting on behalf of any university, college, school district, admissions office, examination board, or governing body in Canada, the United States, the United Kingdom, or internationally.

While we provide guidance based on professional experience and publicly available information:

  • We do not guarantee admission to any institution, program, or course of study

  • We do not guarantee scholarships, financial aid, or academic outcomes

  • All admissions decisions are made solely by the relevant educational institutions

Admissions requirements, deadlines, and evaluation criteria may change at any time and remain outside our control.

3. Scope and Limitations of Services

Our role is to advise, coach, and review materials at the Client’s request. Unless explicitly agreed to in writing and permitted by the institution, we do not:

  • Complete applications on behalf of students

  • Submit applications or documents on a student’s behalf

  • Misrepresent a student’s work, identity, or qualifications

All final application submissions are the responsibility of the student and/or parent or legal guardian.

4. International Applications (US, UK, and Other Jurisdictions)

For applications outside Canada:

  • Application processes, timelines, and evaluation criteria vary by country and institution

  • Guidance is based on current best practices and experience, but requirements may change

  • Students and families are responsible for confirming official requirements directly with institutions

We are not responsible for outcomes affected by changes in international admissions policies, standardized testing requirements, visa or immigration regulations, or external factors beyond our control.

5. Client Responsibilities

The Client agrees to:

  • Provide accurate, truthful, and complete information

  • Submit materials for review in a timely manner

  • Review all application materials before submission

  • Meet all institutional deadlines

We are not responsible for outcomes affected by inaccurate information, late submissions, or materials altered without our review.

6. Services for Minors (K–12 Clients)

For students under the age of 19 in British Columbia:

  • A parent or legal guardian must provide consent

  • A parent or guardian may be required to participate in communications or sessions

  • We do not act in loco parentis and do not provide supervision beyond the scope of educational consulting

7. Fees, Packages, and Payment

  • Fees for hourly services and packages will be disclosed in advance

  • All fees are in Canadian dollars (CAD) unless otherwise stated

  • Payment is due as outlined at the time of booking or invoicing

  • Services may be paused or suspended if payment is overdue

8. Cancellations, Rescheduling, and Refunds

  • Sessions must be cancelled or rescheduled with at least 24 hours’ notice

  • Late cancellations or missed sessions may be charged in full

  • Fees for completed services are non-refundable

  • Refunds for packages, if any, are governed by the specific package terms

9. Ethical Standards

Clients agree not to request or engage in conduct that violates institutional policies, including plagiarism, falsification of records, or misrepresentation.

We reserve the right to refuse or terminate services if ethical standards are compromised.

10. Intellectual Property

All materials provided by ES Advising, including templates, worksheets, guides, and written feedback, are for personal use only.

These materials may not be copied, shared, distributed, or reproduced without prior written consent.

11. Privacy and Confidentiality

We handle personal information in accordance with our Privacy Policy, the Personal Information Protection Act (British Columbia), and applicable Canadian privacy laws.

Personal information is not shared without consent except where required by law.

12. Limitation of Liability

To the fullest extent permitted by law:

  • ES Advising  is not liable for indirect, incidental, or consequential damages

  • Our total liability is limited to the fees paid for the services provided

Admissions decisions, academic outcomes, and educational results remain the responsibility of the Client and/or student.

13. Termination of Services

Either party may terminate services with reasonable written notice.

We reserve the right to terminate services immediately if these Terms are violated or if continued engagement is not appropriate.

14. Governing Law

These Terms & Conditions are governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable laws of Canada.
